Program overview
Quivy offers a mobile messaging program (the “Program”) that allows users to receive marketing messages via SMS/MMS. By opting into the Program, you agree to these Mobile Messaging Terms and Conditions and our Privacy Policy (collectively referred to as the “Agreement”). Participation in the Program constitutes your acceptance of these terms, including your agreement to resolve disputes through binding, individual arbitration as outlined in the “Dispute Resolution” section below. This Agreement applies exclusively to the Program and does not modify other Terms of Service or Privacy Policies governing your relationship with us.
User opt-in
By affirmatively opting into the Program, you consent to receive SMS/MMS messages at the phone number provided during enrollment. Consent is not required for purchases. Messages may include marketing promotions, product updates, and checkout reminders. You acknowledge that some messages may be sent using an automatic telephone dialing system (“autodialer”), though this does not imply all messages are sent via ATDS. Message and data rates may apply. Message frequency varies based on your interaction with us.
User opt-out
To stop participating in the Program, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from us. You may receive one final confirmation message after opting out. These are the only acceptable methods of opting out. Attempts to opt out using other methods, such as texting alternative words or verbally requesting removal, are not valid.
Program description
Participants opting into the Program will receive recurring messages about product marketing, promotions, and sales. Additional messages may be sent based on user activity, such as abandoned cart reminders.
Cost and frequency
Message and data rates may apply. Message frequency varies and may increase based on user engagement.
Support instructions
For support regarding the Program, text “HELP” to the number you received messages from or email us at our support email. Opt-out requests must follow the procedures outlined above; emailing support is not a valid opt-out method.
Mms disclosure
If your mobile device does not support MMS messaging, the Program will send SMS messages instead.
Disclaimer of warranty
The Program is provided on an “as-is” basis and may not function in all areas or under all circumstances. We are not liable for delays or failures in message delivery, which are subject to your wireless carrier’s transmission capabilities. Carriers are not responsible for delayed or undelivered messages.
Participant requirements
Participants must own a wireless device capable of two-way messaging, use a participating wireless carrier, and have an active text messaging subscription. Not all carriers support the Program; check your device and carrier capabilities for compatibility.
Age restriction
You may not use or engage with the Program if you are under thirteen (13) years of age. If you are between thirteen (13) and eighteen (18), you must have parental or legal guardian permission to participate. By using the Program, you confirm that you meet these requirements and are permitted by applicable law in your jurisdiction.
Prohibited content
Participants agree not to send prohibited content via the Program, including but not limited to:
Fraudulent, defamatory, harassing, or stalking content
Objectionable material such as profanity, violence, bigotry, or discrimination
Harmful code such as viruses, worms, or Trojan horses
Unlawful promotions, products, or services
Content referencing personal health information protected under HIPAA or HITEC
Any content prohibited by applicable laws in your jurisdiction
